Regulatory Changes to the Immigration and Refugee Protection Regulations impacting those who hire Temporary Foreign Workers, effective September 26, 2022

As of September 26, 2022, employers who hire Temporary Foreign Workers in Canada under any of the International Mobility Program work permit categories (IE. a non-Labour Market Impact Assessment based work permit) will be subject to an enhanced compliance regime and requirements around employment agreements.  On that date, all of the following is required:

i) On or before the first day of work, the temporary foreign worker must be provided with information about their rights in Canada

ii) Throughout the period of employment, the employer must continue to make the information about their rights available to the temporary foreign worker by posting same in an accessible location (physical or virtual)

iii) There must be an employment agreement signed and dated by the temporary foreign worker and the employer prior to submitting an offer of employment to the Employer Portal

iv) The work place must be abuse free

v) No recruitment fees relating to the temporary foreign worker can be recovered at anytime before, after, during the period of employment

vi) The employer must provide access to health care services if the temporary foreign worker is injured/becomes ill at work.

Consequences for a violation can include a warning letter, a fine, a ban from the temporary worker program for a period of time or a combination of these consequences.
