EB-1C Visa – Multinational Executives and Managers
The EB-1C visa is an employment-based immigrant visa category which enables multinational executives and managers to obtain permanent residency (a green card) in the United States. It is designated for executives and managers of multinational companies who are being transferred to a U.S. affiliate, subsidiary, or parent company.
EB-1C Visa Requirements
To qualify for the EB-1C visa, the applicant must have been employed outside the United States as an executive or manager for at least one year within the three years preceding the petition. The applicant must be entering the United States to continue working for the same employer, a subsidiary, affiliate, or parent company in a similar managerial or executive capacity.
The EB-1C visa requirements necessitate that the applicant’s foreign company must possess a qualifying relationship with the U.S. company. This relationship can be in the form of a parent company, subsidiary, affiliate, or branch office. The U.S. company must have been doing business for at least one year before filing the petition. The applicant must be able to demonstrate that they have been employed in an executive or managerial capacity by the company. An executive role involves directing the management of an organization or a major component of it. A managerial role involves the supervising and controlling of the work of other managers or professionals or managing an essential function of the organization.
The U.S. employer must file a Form I-140, Immigrant Petition for Alien Worker, on behalf of the employee, to establish the eligibility of the applicant for the EB-1C visa. If the EB-1C petition is approved, the applicant and their eligible dependents can apply for adjustment of status to become lawful permanent residents (green card holders) in the United States.
